I played session drums for a guy who's band fell apart right before they were gonna record. He had already paid for time at a new studio (we were actually the first to record there) and he had paid for about 20 hours and gotten a sweet deal. The guy also told him he didn't mind runnig over on time some if that's what it took to make it sound good.

He stretched it out to about 60 hours with nit-picking remixes when the first mix sounded great. Finally, the guy cut him off and he sued trying to get his $400 back. He asked me if I'd testify and I said, "I don't really think you want me to."

He finally settled out of court for $100, though he tells everybody that he "won."

The mcadonalds case with coffee has more to it than what is commonly spread. Not that I dont think that there are many frivouls lawsuits, or that the problem could eb sovled with a few less warning labels, but the "hot coffee' case is one where the misinformation abounds (& in Mcdonalds favour).

Ie that mcadonald had had warnings for ten years about the health hazard, (Managers were on written record stating they aware of risk but dont turn it down, and McDonalds produced documents showing more than 700 claims by people burned by its coffee between 1982 and 1992), the woman only wanted medical expensives at first for her thrid degree burns, (she was hospitalized for eight days, during which time she underwent skin grafting. Liebeck, who also underwent debridement treatments, sought to settle her claim for $20,000, but McDonalds refused) the coffee was always kept 20 degrees hotter that everywhere else or suggested.

Thanks for the more accurate info regarding the McDonalds case, Bert. I remember when McD used to serve very hot coffee. I liked it that way, because I'd often get it at drive-thru, and by the time I got to where I wanted to drink it, it was still hot. I suspect a few other people liked it hot too, as it says in one of those articles.

For me, if a McD employee had spilt the coffee on someone, then we'd have a valid lawsuit. You spill hot coffee on yourself, too bad. Again, that's me. I tend to hold myself responsible for most of my actions.

I couldn't agree more. Was it too hot...yeah evidently, but she spilled it. I'm not gonna sue the companythat made the folding chair too hard because I broke my toe when I accidentally kicked it playing hackey-Sack.

The temperature issue is pretty involved. Most Coffee shops and manufacturers recommend keeping it about 190 degrees, which can be hot enough to scald.

Thanks for the more accurate info regarding the McDonalds case, Bert. I remember when McD used to serve very hot coffee. I liked it that way, because I'd often get it at drive-thru, and by the time I got to where I wanted to drink it, it was still hot. I suspect a few other people liked it hot too, as it says in one of those articles.

For me, if a McD employee had spilt the coffee on someone, then we'd have a valid lawsuit. You spill hot coffee on yourself, too bad. Again, that's me. I tend to hold myself responsible for most of my actions.


I couldn't agree more. Was it too hot...yeah evidently, but she spilled it. I'm not gonna sue the companythat made the folding chair too hard because I broke my toe when I accidentally kicked it playing hackey-Sack.


Agreed if there is some sort of roof for the temperature.

The mcadonalds case with coffee has more to it than what is commonly spread. Not that I dont think that there are many frivouls lawsuits, or that the problem could eb sovled with a few less warning labels, but the "hot coffee' case is one where the misinformation abounds (& in Mcdonalds favour).

Ie that mcadonald had had warnings for ten years about the health hazard, (Managers were on written record stating they aware of risk but dont turn it down, and McDonalds produced documents showing more than 700 claims by people burned by its coffee between 1982 and 1992), the woman only wanted medical expensives at first for her thrid degree burns, (she was hospitalized for eight days, during which time she underwent skin grafting. Liebeck, who also underwent debridement treatments, sought to settle her claim for $20,000, but McDonalds refused) the coffee was always kept 20 degrees hotter that everywhere else or suggested.

Maybe it is valid, but  I don't think you should sue someone for accidentaly spilling some stupid coffee on you...

It depends on how it happens.  If the employee is not concentrating on his/her job (as in joking with a friend and not looking at what he/she is doing), and the coffee is spilled onto me and causes severe burns, then I will sue.  Again, if I spill it on myself, that's my problem.
