I think that if you're running a tournament that is sanctioned as "Constructed" then it cannot have any additional restrictions/limitations imposed that do not appear in the sections describing warband construction.

I agree with with Kithmaker. If you read the floor rules (you can find it on the Wizards website) they outline what the rules/requirments for warband building would be.

That said, I don't see why you couldn't have a house rule or something for the tournement. You would just need to be sure everyone knew before hand. If you did tell Wizards you were going to run a tournement, you might have problems with someone seeing a tounry at your FLGS and show up with a warband that would not be valid with your house rule tourney.

Might be easiest to alternate sancationed tourney's one week, fun/themed bands the next week.

You would probably be fine running this at yoru FLGS, but where you have an issue would be that when you try to sanction it, it would be posted on Wizard's site as a sanctioned tourney. You may have people from your store show up and they would be expection to play a 200 point assault format and you have scheduled a 200 point assault no rares tourney. I don't believe there is a way to state this to Wizards and still get sanctioned.

If all participants wanted to agree to something off-line, it's still a 200 point constructed event. So if you did no-rares and you got your regular 8 guys to agree, great. If two more folks show up that aren't regulars and are playing with 4 rares each, tough nuggies ... they get to play with their rares as that is the DCI format.
