I believe it is because they are not spells they are special abilities. Special abilities do not follow the same rules as spells. They can be used when based, they aren't subject to the beholder, etc.

Your title says "DR". Damage Reduction doesn't apply to spells, breath weapons, etc. If you mean spell resistance, then remember that special abilities aren't subject to SR. That's why it says the Fire Wand is subject to SR.
